Your questions about department of aging

Chris asks…
Can department of Aging people be sued for causing mental duress to disabled person?
Recently we almost lost our house. A department of Aging person told my husband who is paraplegic that when we lose the house that he would be put in a nursing home, two of our children who are 10 and 14 yrs old in foster care and I and our oldest child who is 21 on the street. Person who said this did not seem happy when we let her know we wern’t going to lose our house.

Girl Talk answers:

Donna asks…
Previous employer, Texas Department of Aging and Disability Services, Open Records Attny. issued HIPPA info.?
My previous employer was the Texas Department of Aging and Disability Services. They issued HIPPA information VIA an Open Records request. Is this illegal? What, if any, is my legal cause of action?
They issued information expressly protected under federal HIPPA laws. I am aware of the office which has jurisdiction over said violations. Seeking legal advice. Information issued included: Name, Social Security Number, Treatment information, Treatment Dates, Return-to-work restrictions, Address, Phone Numbers, et cetera…
Apologize for the mispelling of the acronym. I am not a all that interested in the alphabetical configuration of words, just the basic idea/subject matter.

Girl Talk answers:
What exactly did they release? The HIPAA law prevents certain information. from being released. There is a federal office that handles hipaa complaints.
OK, they most likely violated HIPAA. Your cause of action here is a violation of the HIPAA law. I believe that the only remedy is to file a complaint with the Office of Civil Rights.

Lizzie asks…
Is it possible to be director of a department at age 28? Can you be younger?
Just curiosity..
And does it matter where you do your bachelors?
Does only postgraduate matter alot?

Girl Talk answers:
Yes. Age has little to do with your title. When companies look for managers they look more at experience and ability to get the job done than age. There are many twice your age who do not have management abilities. And it doesn’t make any difference where you get either your BS or MBA as long as the school is properly accredited.
